Terms and Conditions

These terms define the general rules for using the website and for services provided by GlobalMighty Development.

Identification

GlobalMighty Development is a brand used by Mariana Ramalhão Gabriel, an independent professional.

The main contact is contacto@globalmighty.pt and the official website is globalmighty.pt.

Mandatory legal information is provided whenever applicable, namely in the proposal, contract or invoicing document, under applicable law.

Our services

We provide website development, custom software, digital restructuring, automation, ecommerce and support and evolution services.

We provide services to companies and individuals, mainly in Portugal, and are also available to review international projects.

Proposals, scope and payments

Each project starts with an analysis. The scope, value, timeline, delivery stages, included content and payment conditions are defined in the proposal or contract.

Payments are agreed between the parties. Bank transfer, MB WAY or other agreed methods may be used.

New features, out-of-scope changes or additional requests are analysed separately and may require a new quote.

The proposal or contract accepted by the parties prevails over these Terms for the project concerned.

Client responsibilities

The client is responsible for providing correct information, content, access and decisions needed for the project to move forward.

The client is responsible for the legality of content, images, brands, logos and other materials supplied for use in the project. These materials must respect the relevant usage and intellectual property rights.

Developed work and portfolio

Until full payment of the project, the developed work remains the property of GlobalMighty Development, unless otherwise agreed in writing. After full payment, rights are transferred to the client under the terms defined in the proposal or contract.

Unless otherwise agreed, source code, technical documentation, editable files or other working elements are delivered only when provided for in the proposal or contract.

Libraries, tools, software, fonts, integrations and third-party services retain their respective licences and conditions.

Publication of work in the portfolio is done only with client authorisation.

Domain, hosting and external services

Domains, hosting, email accounts, subscriptions, integrations, payment gateways and other third-party services may be contracted and paid directly by the client to the relevant providers.

These services follow the providers’ own terms. Regular backups are only included when they are part of a contracted maintenance or hosting service.

Support after delivery

Unless otherwise stated in the proposal, 2 months of support after delivery are included, with a maximum total limit of 3 hours.

This support covers small adjustments to text, images, contacts, colours, buttons and correction of errors related to the delivered development. Support time is counted cumulatively and according to time actually spent.

It does not include new pages, new features, structural changes, design redesign, integrations, content production, problems caused by third parties or requests that exceed the total 3-hour limit.

Requests outside this support are analysed and, if it makes sense to proceed, presented in a new quote.

Service limits

Although we follow good development practices, we cannot guarantee permanent availability of external services or specific commercial results. We are also not responsible for downtime or failures caused by third-party services outside our control.

Cancellation and suspension

Cancellation, suspension and any refund conditions are defined in the proposal or contract. In case of cancellation, work already carried out and costs already incurred may be invoiced, under the terms agreed between the parties.

When the client is a consumer, mandatory rights provided by law apply. Early execution of services during any withdrawal period is regulated in the contract.

Changes to the terms

These terms may be updated to reflect changes to services or applicable law. The version published on this page is the version in force.
